This eBay Malaysia & Philippines “Guess the Price' Contest (“the Contest”) is subject to the following terms and conditions and by participating in the Contest all entrants will be deemed to have accepted and agreed to be bound by these terms and conditions.


Contest Rules

Participants will be able to win some exciting prizes simply by guessing the right selling price of selected items sold on eBay . The contest rules are:

 
 
1) Each participant can submit as many price guesses as they wish but only the last submission of each participant will be counted towards the weekly contest winners. All submissions for the relevant week must be received by 23:59:59 GST of that particular Saturday.
 
 
2) Winners will be selected based on the closest match to the average selling price of a similar item sold during the same week on eBay.com, eBay.co.uk, eBay.com.my or eBay.ph. If more than one participant submits a correct guess, the winner will be the participant who submitted the earliest correct guess.
   
3) There will be only one weekly winner and the prizes will be the same items featured onsite for the Contest.  Prizes will be sent to the winners approximately 6-8 weeks after the Contest ends on December 31, 2007.
   
 
 

Contest Dates

 
 
   
1) The Contest will commence from 0:0:01 December 1 st, 2007 to 23:59:59 GST December 31 st, 2007 (both dates inclusive).
   
2) Winners will be selected by eBay on 15 Jan 2008 and they will be notified through their primary email address on record within 3 weeks of the Contest date.
   
3) eBay reserves the right to draw reserve winners to substitute any winner subsequently found to be ineligible or disqualified.

1) There shall be a total of eight winners for the Contest. Four winners each from Malaysia and Philippines will each be entitled to win the following prizes:

2) Each participant shall not be entitled to win more than one prize in the Contest.
   
3) eBay may, at any time without notice at its sole and absolute discretion, substitute any prize with another prize of similar value.
   
4) eBay does not offer any warranty, nor is not responsible for broken or damaged goods occurring during shipping. Each winner shall accept the prize on an "as is where is" basis.
   
5) eBay shall not be responsible for the quality, merchantability or the fitness for any purpose or any other aspect of the prize. Notwithstanding anything herein, eBay shall not at any time be responsible or held liable for any defect or malfunction in the prize, and/or for any loss, injury, damage or harm suffered or incurred by or in connection with the use of the prize by any person.
   
6) Where a winning user remains un-contactable and the prize unclaimed for 2 months after the date of the contest, it will be forfeited and donated to any charitable organization as eBay may determine.
   
7) No cash alternatives will be substituted for prizes.
 
     
 

Eligibility

 
 
   
1) The Contest is open to all eBay users who have registered with eBay and have addresses located either in Malaysia or Philippines. eBay users who have registered addresses in Malaysia shall be eligible to win the prizes as set out at http://www.ebay.com.my/guesstheprice only, and eBay users who have registered addresses in Philippines shall be eligible to win the prizes as set out at http://www.ebay.ph/guesstheprice only.
   
2) Participants must be legal residents of these countries and 18 years of age or older. Eligibility is not transferable. Participants will not be eligible for the Contest if their eBay accounts are not in Good Standing. In order for a participant's account to be deemed in Good Standing as that term is used herein, it must not have a hold on the participant's account(s) and the account(s) must not be suspended, limited, or past due as of November 30th, 2007. In the event any account is suspended, cancelled or terminated at any time for any reason whatsoever during the Contest period, eBay shall at its sole discretion, revoke the eligibility for such account holder(s) to participate in the Contest, without incurring any liability and/or without giving any prior notice.
   
3) Use of automated entry devices or programs is prohibited.
   
4) If a winner is subsequently discovered to be ineligible to participate in the Contest or ineligible to receive the prize, eBay reserves the right to forfeit/reclaim the prize at its discretion and confer the same on such other person as may be selected in such manner as eBay deems fit. No person shall be entitled to any payment or compensation from eBay should the prize be forfeited.
   
5) Employees of eBay International A.G. and all their respective subsidiaries, affiliates, and their immediate families (spouse, parents, children, siblings and their respective spouses) and individuals living in the same household as such employees are ineligible.
   
 
  Liability  
 
   
1) eBay reminds participants of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect entry to the Contest or reaching the specified targets.
   
2) eBay shall not be liable, in contract or tort (including negligence) or breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from this Contest, provided that nothing in these terms shall limit eBay's liability for death, personal injury or fraud.
   
3) eBay is not responsible for printing or typographical errors in any Contest related materials; for stolen, lost, late, misdirected prizes; or for transactions and/or emails that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this Contest, or process any transaction thereon.
   
4) If in eBay's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Contest, eBay reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, to modify or suspend the Contest, or to terminate the Contest.
   
5) In all matters relating to the interpretation and application of any rule or phase of this Contest, the decision of eBay shall be final.
   
6) eBay reserves the right to cancel, amend or revoke the offer at any time due to reasonable business consideration or circumstances beyond its control. Any attempt by a participant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, eBay reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempts by an individual to access any web site associated with this Contest via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible.
   
7) These official Terms and Conditions will be interpreted, construed and enforced in all aspects in accordance to the laws of Singapore and all participants hereby submit to the non-exclusive jurisdiction of the Singapore courts.
   
8) Any decisions by eBay relating to this Contest are final, conclusive and binding and no correspondence will be entertained.
