Human remains policy

The listing of humans, the human body, any human body parts or human remains are not permitted on eBay. However, items that contain human hair (such as lockets) as well as skulls and skeletons that are used for medical purposes may be listed on eBay.

Please note that the following activities are prohibited on eBay:

  • The trading of human corpses or remains,
  • The trading in organs and blood, and
  • The commercial trading in human eggs, embryos, etc which can be used for the purposes of certain reproductive technologies.

[Note : Please note that there are no specific laws in Malaysia that prohibit the trading of the human corpses or remains, organs and blood etc.. However, eBay may as a matter of policy prohibit such activities. The Human Tissues Act 1974 allows the removal of tissues from cadavers under certain circumstances but does not ban the sale or purchase of organs. The Act also remains silent in relation to the removal of organs from live donors. The Prevention and Control of Infectious Diseases (importation and exportation of human remains, human tissues and pathogenic organisms and substances) Regulations 2006 stipulate that approval is required in order to import or export of human remains and tissues but also remains silent in relation to the trading.

Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.
