Prescription Drugs

Controlled drugs or items (or their components) that require a prescription from a licensed practitioner (such as a doctor, dentist, ophthalmologist or optometrist) are not permitted on eBay; this includes drugs prescribed by veterinarians for animals. Under Malaysian law, it is an offence to sell, supply or export any medicinal product without a product registration. In particular, the Sale of Drugs Act 1952 and Control of Drugs and Cosmetics Regulations 1984 require all medicinal products sold in Malaysia and manufactured or sold to be registered with the National Pharmaceutical Control Bureau or the Drug Control Bureau of the Ministry of Health. The Medicines (Advertisement and Sale) Act 1956 also prohibits advertisements of medicines relating to certain diseases like diabetes, epilepsy or hypertension. All products which are not stated in the General Sale List are prohibited from sale on eBay.

Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

Some Examples

All forms of drugs for medicinal purpose are required to be registered with the Drug Control Authority of the Ministry of Health.

Additional Information
  • “product” is defined in the Control of Drugs and Cosmetics Regulations 1984 as

    (a) a drug in a dosage unit or otherwise, for use wholly or mainly by being administered to one or more human beings or animals for a medicinal purpose; (b) a drug to be used as an ingredient of a preparation for a medicinal purpose; or

    (c) a cosmetic

  • Product registration is required for manufacture, sale, supply, import or possess for sale of any medicinal product.

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since the sale of prescription drugs are prohibited by law, regulated or may cause harm to eBay or its members, sellers may not list them on eBay.
