Describing Drugs or Drug-like Substances

eBay prohibits sellers from describing legal substances in a manner that suggests ingesting, inhaling, extracting or otherwise using any substance or compound from the legal substance will provide the same effect as an illegal drug, compound or substance or that will provide unsubstantiated health benefits.

Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Loss of eBay fees

  • Limits placed on account privileges

  • Loss of PowerSeller status

  • Account suspension

Some Examples
  • Listing substances with the claim that it can be used to treat or cure sexual function, infertility or impotency.

  • Advertising any article or substance with the claim that it will cure blindness, cancer, drug addiction, etc

Additional Information
  • Under Malaysian law, it is an offense for any person to knowingly sell, offer or expose for sale, or issue from a dispensary for medicinal purposes, any drug or medical preparation, as a different drug or medical preparation. It is also an offense for sellers to advertise in such a manner which is calculated to lead to the use of any substances as a medicine, appliance or remedy for the purpose of treatment of human beings for diseases and conditions such as cancer, drug addiction and epilepsy.

  • A full list of the diseases and conditions can be found in the Schedule to the Medicines (Advertisement and Sale) Act 1956.

Why does eBay have this policy?

eBay urges its sellers and buyers to comply with all governmental laws and regulations. Since certain unsubstantiated promotional and marketing claims related to drugs and drug-like substances are prohibited by law and sales of these items may cause harm to eBay or its members, sellers may not market items with such claims on eBay.
